Shimla Agreement between Indo pak

India uses the Shimla Agreement for objecting to third country mediation on any Indo-Pak issue, including Kashmir. It uses the same pretext against adjudication by the International Court of Justice too. The Simla Agreement was signed by Pakistan under duress because more than 90,000 Pakistanis were India's prisoners of war. Pakistan has a strong case to take Indo-Pak issues, including Kashmir, to the ICJ. Sixty-one years have gone by without settlement of Kashmir dispute because of India's dilly dallying. Since the world's major powers, including US and UK are not prepared to mediate unless India too agrees to mediation, it is high time that Pakistan denounces the Simla Agreement on grounds of having had to sign it under duress and goes to the ICJ to settle Indo-Pak issues, including Kashmir. The US President, Mr Barack Obama should be asked that he should not fight shy of intervening on Kashmir because there is a standing promise of great President J F Kennedy to President Ayub that, if Pakistan didn't exploit the 1962 Indo-China war by sending its troops into Indian Occupied Kashmir, US will help settle Kashmir dispute. President Ayub responded positively, but US has yet to fulfill its part. India should also be reminded that it cannot hide behind the unjust Simla Agreement as it has a part in Kashmir to play in the context of the war against terror.
